By using our services you are agreeing to the following Terms and Conditions. These may change from time to time at our discretion therefore they should be checked periodically.
‘Client’ or ‘Clients’ means a company or individual who orders
services offered by RealScope or a Realscope Franchisee.
‘Property’ means the Client’s property for which we are engaged to
photograph and provide our image and floor plan services.
‘RealScope’ means RealScope ABN 98 167 887 809
‘RealScope Franchisee’ means a company or individual appointed by
RealScope as a franchisee.
‘Us’ means RealScope or our Realscope Franchisee as the case may be
and ‘we’ and ‘our’ have corresponding meanings.
‘You’ means you the Client who has engaged us to provide products and
services and ‘your’ has a corresponding meaning
2.1 The ownership of and copyright in all photographs, products and services of any kind supplied by us to our Clients remains our property unless otherwise agreed in writing.
2.2 The photographs, images and floor plans we provide are to be used for the express use of marketing the Property for sale or for rent. Our products and services cannot be resold or reused or supplied to a third party for any other purpose or in any other way without our prior written permission.
3.1 We take all reasonable care to provide a high quality product and service to our Clients.
3.2 Our floor plan pricing includes one set of complimentary amendments. This does not include structural changes.
3.3 If our Clients require reasonable, additional Photoshop work to images then we will undertake this at no charge. Discretionary changes will attract additional charges on a quote basis. Please note that we will not remove or exclude fixed features that would in our reasonable opinion constitute misrepresentation of the Property or its features.
3.4 As all of our products and services are reliant on human performance so we cannot guarantee absolute accuracy.
3.5 We always insist that our Clients proof all works before they proceed with advertising or marketing of any kind.
3.6 Therefore we are not liable for any costs of any kind including reproduction costs, loss of income or ensuing litigation arising from such errors or omissions.
4) Website Terms and Conditions of use
4.1 All content and images contained on RealScope’s web site is the Copyright of RealScope.
4.2 The images, photographs and content on our website is protected by Australian and International copyright and trademark laws. All images, photographs and content on our website cannot be used in anyway by a third party without the written permission of RealScope.
5) Floor Plans
5.1 We charge for floor plans based on the internal floor area only.
5.2 We include in the floor plans external areas that are connected to the house and are usable areas, but do not use this external floor area when charging for our floor plans.
5.3 Usable areas include balconies, courtyards, decks, verandahs, patios and terraces but excludes pathways, walkways and landscaping.
5.4 Site maps are an optional extra which will attract an additional fee.
6) Disclaimer for Floor plans
6.1 We accept no liability for the accuracy or details contained in our floor plans.
6.2 Our floor plans are drawn and also checked to the best of our ability with the ultimate responsibility remaining with the Client to ensure all details are correct before proceeding with marketing or advertising.
6.3 Information contained in our floor plans such as floor areas are approximate and have not been surveyed or drawn to scale and the Client and prospective buyers should rely on their own enquiries before making any decisions. Floor plans are not suitable for lease registration, architectural or building purposes. They contain no structural or engineering information.
6.4 Our floor plans are for representational purposes only and should be used as such. If structural or detailed information is needed our floor plans should not be used.
7.1 Our professional photography involves onsite techniques and post production retouching to ensure we create a top quality product for our Clients.
7.2 If additional time is needed on site or we cannot access the property on time we reserve the right to charge based on an hourly rate which currently is $240 per hour (inclusive of GST).
7.3 If post production editing is required at the Clients’ request that is outside our usual parameters we reserve the right to do this work on a quotation basis.
7.4 We prefer the client approve the photos on the back of the camera onsite before the photographer leaves to ensure we have captured the property to your liking. If the client cannot be present at the shoot we hold no responsibility for missed shots or incorrect angles and our photographer will use their own professional discretion when taking the photographs. Any re-shoots will incur a fee.
8) Working hours
8.1 Our standard working hours are Monday to Friday 8am to 5pm.
8.2 Surcharges apply for dusk/dawn appointments and weekend work.
9) Storage of files
9.1 We will endeavour to archive all floor plans and photographs after 1 month.
9.2 To retrieve floor plans or photographs from archives a fee of $55(inclusive of GST) is applicable. Please see Archived Floor Plans below for further details.
9.3 Photography jobs, with their RAW files included, are stored for 2 months after which time the RAW files are deleted and the core JPEG images are archived.
9.4 There is a cost of $110 (inclusive of GST) to retrieve these images. We do not guarantee that all files will be successfully archived and take no responsibility for images or floor plans that are not available from our archive system.
9.5 Clients are responsible for immediately storing and safely backing up all files we send to Clients to avoid lost data.
10) Storage of Interactive Floor Plans
10.1 We will keep our Clients interactive floor plans hosted for 6 months after which time they will be removed.
10.2 To reinstate these files at a later stage incurs the full fee of $77 (inclusive of GST).
10.3 We cannot guarantee the plans and images will be available.
11) Agent portrait photography
11.1 Portrait work is very personal and subjective therefore we require a detailed client brief to ensure expectations are met.
11.2 Photography must be proofed on site and unless there is an image clarity issue then re-shoots will incur further charges.
12.1 We charge a $55 (inclusive of GST) late cancellation fee if the job is not cancelled more than 2 hours prior to the allocated time or if we arrive and are unable to carry out the work for any reason.
13) Third party work
13.1 RealScope may use third parties such as RealScope Franchisees or other contractors to perform some of our services.
13.2 RealScope uses all reasonable care to ensure the products and services supplied to our Clients are accurate but take no responsibilities for errors or omissions of our RealScope Franchisees or contractors.
14) Service turnaround times
14.1 We always endeavour to supply our photography back to our Client by 5pm the following working day from access.
14.2 We always endeavour to supply floor plans back to our Clients within 2 working days.
14.3 We always endeavour to supply Interactive Floor Plans to our Clients the following working day after the floor plan has been supplied.
14.4 Working days are classified as Monday to Friday.
14.5 Images are sent via Hightail and our Clients will need the necessary program to Un-zip the folders.
14.6 Floor plans are sent via email and no hard copies are supplied.
14.7 Whilst we make every effort to meet the service turnaround periods we take no responsibility for any loss or damage or inconvenience caused by the above time frames not being met as we are reliant on Internet services and third party involvement.
14.8 All of our Clients need to take this into account when booking jobs with us.
15) Archived floor plans
15.1 We archive past floor plans and they are available at a cost of $55 (inclusive of GST).
15.2 This cost does not include any amendments to the plan. If any amendments are necessary to the plans further charges will apply.
16) Redrawing service
16.1 We offer a service to redraw existing plans into the RealScope format.
16.2 Plans must be emailed to us as JPEG files and must be clear and legible.
16.3 Any alterations to these plans as supplied to us will incur additional charges. Once redrawn, any amendments will incur additional charges.
16.4 We are not responsible for incorrect information supplied to us by Clients or other third parties or for errors or omissions to the final product. Refer to Floor Plan section above for further details.
17) Credit Terms
17.1 Our payment terms are 14 days from the date of invoice which are issued monthly.
17.2 For overdue accounts we reserve the right to require payment in advance for any future work until outstanding payments are made at which point we will revert to invoicing monthly.
17.3 Payments can be made by direct deposit, cash or cheque. Credit cards are not accepted. Upfront payments are required for private sellers or one off jobs. A surcharge also applies to private sellers or one off jobs. Please refer to our pricing schedule.
18) Other charges
18.1 Where our staff cannot find appropriate onsite parking and use a paid parking facility this cost will be passed onto our Client in full.
18.2 Travel charges may apply to areas outside Brisbane. Please refer to our pricing schedule for our current pricing.
